The use of force by the soldier might be justified if the migrants’ lives were in immediate danger, given the historical enforcement of toll collection by criminal gangs with lethal violence against migrants seeking to cross into the United States.  

Security analysts and human rights advocates have expressed concerns about the incident. Adam Isacson of the Washington Office on Latin America noted that it is rare for a U.S. soldier on U.S. soil to use force against a civilian. He emphasized the need to establish an imminent risk of loss of life or serious injury to justify such an action. Isacson also pointed out that this is the second time this year that Texas National Guard personnel involved in Operation Lone Star have shot someone. In a previous incident in January, soldiers encountered a group of migrants in a South Texas abandoned house, resulting in a non-life-threatening gunshot wound.  

Governor Abbott’s strong stance on immigration and border security has led him to direct substantial state funds, totaling $4 billion, to Operation Lone Star. However, critics, including immigrant advocacy groups and some Democrats, argue that the operation’s tactics pose a risk to migrants. The Biden administration has even taken legal action to remove a barrier system installed by Abbott in the Rio Grande, which they claim endangers migrants.  

The incident has also sparked discussions about the potential for further aggressive measures along the border. Prominent Republicans, including possible 2024 presidential candidates such as Florida Governor Ron DeSantis, have advocated for more assertive actions, including deploying troops into Mexico to combat drug traffickers and criminal groups. However, Mexican officials have warned that such actions could be construed as an invasion of their country by the United States, potentially jeopardizing their close trade relationship.
